Før du leier båt

Viktige sikkerhetsråd

Norske farvann

Lofoten har en fantastisk skjærgård som innbyr til flotte båtopplevelser og mange muligheter, enten du bruker motorbåt eller er en seiler. Kombinert med fjordene omkranset av høye fjell, er kysten langs Lofotveggen et attraktiv reisemål.

Dersom du legger ut med båt i Lofoten for første gang, er det viktig å være klar over at navigering i dette farvannet krever god planlegging, full fokus og varsomhet. Har du for eksempel leid båt i Hellas eller Kroatia, vil du kunne oppleve at norske farvann har flere undervannsskjær, og ikke minst at temperaturen i vannet er betydelig lavere.

For å forberede deg best mulig på båtturen i norske farvann, før du leier båt, ber vi om at du går igjennom all informasjon på denne siden, og ikke minst bruker 3 minutter på å se sikkerhetsfilmen under.

Direktoratet for samfunnssikkerhet og beredskap (dsb) har produsert en kort sikkerhetsfilm for fisketurisme på norskekysten. Filmen er en oppsummering av forhold båtfolk bør være oppmerksom på, uavhengig av om formålet med båtturen er fiske eller annet. Se sikkerhetsfilm.

Sjøvettreglene

Sikkerhetsfilmen ovenfor oppsummerer Sjøvettreglene på en god måte, og for oss i Lofoten Boat er det en selvfølge at alle som ferdes på sjøen skal kjenne til og følge disse. Dessverre er det i praksis ikke alltid slik, og mange av oss har behov for å bli minnet på reglene før en ny sesong. Vi ber deg derfor også om å lese igjennom disse 7 reglene:

  1. Tenk sikkerhet: Kunnskap og planlegging reduserer risikoen og øker trivselen.
  2. Ta med nødvendig utstyr: Utstyret må holdes i orden og være lett tilgjengelig
  3. Respekter vær og farvann: Båten må bare benyttes under egnede forhold.
  4. Følg sjøveisreglene: Bestemmelsene om vikeplikt, hastighet og lanterneføring må overholdes.
  5. Bruk redningsvest eller flyteplagg: Det er påbudt med godkjent flyteutstyr til alle ombord.
  6. Vær uthvilt og edru: Promillegrensen er 0,8 når du fører båt.
  7. Vis hensyn: Sikkerhet, miljø og trivsel er et felles ansvar.

Vårt sikkerhetsmål

Lofoten Boat har som mål at all båtutleie skal skje uten at det oppstår skade på personer eller materiell. For å oppnå dette målet, har vi iverksatt en rekke tiltak for å forebygge skade og sikre at du som kunde får en sikker og god båtopplevelse.

Ett eksempel på et slikt tiltak, er at du som kunde må signere en sjekkliste på at du har lest og forstått teksten under «Før du leier båt» på våre nettsider før du får utlevert båten.

Betingelser

Leses før leie og utlevering av båt

Noen viktige punkter å være klar over
før du leier båt fra Lofoten Boat:
  1. Leietaker og andre førere av båten må være fylt 20 år.
  2. Leietaker og andre førere av båten født etter 31.12.1979 må fremvise gyldig båtførerbevis.
  3. Ved kjøring av båt i indre havn er maks lovlig hastighet 5 – fem – knop.
  4. Ved kjøring nærmere enn 50 m fra land, badende og badebøyer er maks hastighet 5 knop. (Se lovdata for gjeldene lovverk).
  5. Båten skal ikke benyttes etter mørkets frembrudd.
  6. Båtene til Lofoten Boat er utstyrt med sporingsenheter, som bl.a. registerer hastighet og reiserute.
  7. Det er lagt inn No Go-soner i kartplotter, med varsling til Lofoten Boat om disse ikke overholdes.

1. LEIEPERIODE, OVERLEVERING OG RETUR

Avtalens varighet (“Leieperioden”) skal være fra Utleietidspunkt til Returtidspunkt som angitt ovenfor. Lofoten Boat (heretter kalt «Båteier») skal på Utleietidspunktet overlevere Båten til Leietaker på Overleveringssted som angitt ovenfor og Leietaker skal på Returtidspunktet returnere Båten til Båteier på samme sted med mindre annet skriftlig er avtalt. Begge parter har en gjensidig plikt til å varsle og vente i 30 minutter ved forsinkelse Dersom det på grunn av værforhold ikke er eller vil være forsvarlig å overlevere/returnere Båten slik som avtalt, skal den part som skal overlevere/returnere så snart som mulig og senest en time før avtalt tidspunkt kontakte den annen part for å avtale nytt Utleie eller Returtidspunkt. Nytt Utleie eller Returtidspunkt skal avtales så snart værforholdene gjør det forsvarlig. Dersom Leietaker ikke møter opp til avtalt Utleietidspunkt begynner Leieperioden å løpe, og Lofoten Boat kan ilegge gebyr som følge av manglende avhenting i henhold til enhver tids gjeldende satser fastsatt av Lofoten Boat og publisert på  www.svolvaerhavn.no/baatutleie-lofoten.

Dersom leietakeren uteblir i mer enn én dag, når leietiden er over en uke og det skjer uten at leietaker gir noen melding til utleieren, faller leieforholdet bort. I slike tilfeller skal leietakeren likevel betale full leie for første hele uke. For senere leieuker skal leieprisen reduseres tilsvarende oppnådd erstatningsutleie.

Dersom leietaker ikke møter opp til avtalt Returtidspunkt påløper gebyr for manglende retur i henhold til enhver tids gjeldende satser fastsatt av Lofoten Boat og publisert på www.svolvaerhavn.no/baatutleie-lofoten. Ved manglende oppmøte på avtalt Returtidspunkt fortsetter Leieperioden å løpe på avtalens øvrige vilkår inntil båten returneres til Utleier. Leietaker er i slike tilfeller ansvarlig for å returnere Båten på sted angitt av Båteier.

Leietaker er ansvarlig for alle utgifter, kostnader og tap Båteier påføres dersom Båten ikke returneres til avtalt Returtidspunkt.

2. LEIEPRIS

Leietaker plikter å innbetale til Lofoten Boat leieprisen angitt ovenfor. Eventuelle ekstra tilvalg og ekstrautstyr og tjenester kommer i tillegg og følger gjeldene prisliste. Ved utsatt Utleietidspunkt på grunn av værforhold som nevnt i pkt. l, skal Leieperioden etter avtale forlenges tilsvarende utsettelsen. Dersom det ikke er mulig å forlenge Leieperioden (for eksempel fordi båten er leid ut eller fordi Leietaker ikke har anledning til å bruke den) skal Leieprisen avkortes.

Ved utsatt overlevering på grunn av forhold som skyldes Båteier eller forhold som Båteier har risikoen for, kan Leietaker be om at Leieperioden forlenges tilsvarende utsettelsen eller at Leieprisen avkortes tilsvarende utsettelsen. Dersom det ikke er mulig å forlenge Leieperioden (for eksempel fordi båten er leid ut eller fordi Leietaker ikke har anledning til å bruke den) skal Leieprisen reduseres tilsvarende utsettelsen.

3. SÆRLIG AVTALE OM TRANSPORT

Dersom partene har avtalt overlevering og/ eller retur på et sted utenfor Båteiers adresse og båtens hjemmehavn kan Lofoten Boat tilby transport av Båten etter nærmere avtale.

4. BÅTENS TILSTAND VED OVERLEVERING OG UTLEIERS PLIKTER

Båten skal ved overlevering være i kontraktsmessig stand, rengjort og ha full drivstofftank. Ved overlevering skal Leietaker og Båteier sammen gjennomgå hele Båten ved bruk av hensiktsmessig sjekklister som Lofoten Boat innehar. Sjekklister for gjennomgang av aktuell båt krysses av som eget punkt i kontrakt. Dersom Båten ikke er klar til overlevering til avtalt tid på grunn av forhold på Båteiers side, skal leien avkortes med en dags leie for hver påbegynt dag. Er forsinkelsen mer enn en dag ved inntil en ukes leie, eller mer enn to dager ved mer enn en ukes leie, kan Leietaker velge om han vil fastholde eller gå fra avtalen. Hvis Båten ikke er i kontraktsmessig stand, kan Leietaker kreve avslag i leieprisen. Er mangelen av alvorlig karakter kan Leietakeren velge å gå fra avtalen. Dersom Båten ikke kan benyttes i en del av Leieperioden, og dette skyldes forhold som Båteier er ansvarlig for, skal leien avkortes forholdsvis Er avbruddet langvarig, kan Leietakeren gå fra avtalen dersom formålet med leieforholdet blir vesentlig endret.

5. BÅTENS TILSTAND VED RETUR, SKADER OG LEIETAKERS PLIKTER

Båten skal ved retur være i samme stand som ved overlevering, rengjort og ha full drivstofftank, med mindre annet er avtalt.

Dersom Båten ved retur ikke er tilfredsstillende rengjort eller fulltanket belastes Leietaker et gebyr for vask og/ eller et gebyr for drivstolfylling, samt pumpepris (dog minimum 30,- pr liter) for manglende drivstoff etter gjeldende satser. Gjeldene satser pris for drivstoff er den aktuelle dagens satser på Cirkle K, Svolvær brygges bensinpumpestasjon.

Leietaker er ansvarlig for tyveri og enhver skade eller mangel på Båten, herunder Båtens motor og utstyr, annen skade eller erstatningsansvar som er pådratt, påført eller oppstår som følge av Leietakers bruk av Båten. Leietaker er økonomisk ansvarlig for utgifter som påfaller Båteier i forbindelse med rengjøring, reparasjoner og transport grunnet innvendige og utvendige skader og/ eller skadeverk påført Båten i leieperioden. Båten er forsikret, ved tyveri eller skade/ansvar som helt eller delvis dekkes av forsikring er Leietaker ansvarlig for betaling av Båteiers egenandel samt eventuelt andre økonomiske tap.

Dersom det oppstår problemer av noen art med Båten i løpet av Leieperioden plikter Leietaker å umiddelbart underrette Lofoten Boat om det inntrufne. Ved ikke uvesentlige skader er leietaker forpliktet til å følge Lofoten Boats instruksjoner.

6. KRAV TIL LEIETAKER OG FØRER(E) AV BÅTEN

Leietaker må inneha nødvendig og tilstrekkelig kompetanse for å leie og føre Båten. Leietaker og andre førere av båten skal være fylt 20 år. Er leietaker og andre førere av båten født etter 01.01.1980 skal gyldig båtførerbevis fremlegges. Kartlegging av slik kompetanse er en viktig del av reservasjonsprosessen og må gjennomføres av Leietaker før reservasjonen gjennomføres. Dette for å sikre at leietaker har den nødvendige kompetanse og riktige holdninger for en trygg ferdsel til sjøs. Det er Leietakers ansvar å forsikre seg om at de er kjent i området de skal ferdes i og at alle passasjerer har forskriftsmessige redningsvester i riktig størrelse. Det er Leietakers ansvar å forsikre seg om at han eller hun innehar tilstrekkelig kompetanse for å betjene alle aspektene ved å føre en båt.

Leietaker bekrefter at alle førere av Båten i Leieperioden er over 20 år og innehar tilstrekkelig kunnskap og eventuelle sertifikater/bevis som kreves for å føre Båten. Leietaker er ansvarlig for at alle førere av Båten på forhånd er gjort kjent med vilkårene i denne avtale.

Dersom Leietaker har oppgitt gale opplysninger om egne eller andre føreres kvalifikasjoner og ferdigheter, eller at det av andre grunner anses klart uforsvarlig å utlevere fartøyet, har Båteier rett til å si opp avtalen med umiddelbar virkning.

Ved fortøyning av båten er Leietaker eller fører av Båten forpliktet til å sørge for at Båten er forsvarlig festet på en brygge/fortøyningsplass hvor dette er avklart med anleggets/plassens eier. Likeledes plikter leietaker eller fører av Båten å sørge for at Båten er forsvarlig lukket og låst.

7. LEIETAKERS VEDLIKEHOLDSPLIKT

Leietaker skal i leieperioden sørge for at Båten blir vedlikeholdt, herunder med tanke på smøreoljer, kjølevann og væsker. Ved tvil om vedlikehold kontaktes Båteier.

8. BEGRENSNING PÅ BRUK AV BÅTEN OG SÆRLIGE BESTEMMELSER

Båten kan kun benyttes i skandinavisk farvann. Båten må ikke benyttes til å trekke paragliders eller lignende utstyr. Båten kan heller ikke benyttes til slepeoppdrag, berging av andre båter, (unntatt ved nødsituasjoner), transportoppdrag der leietager tar betalt for oppdraget, utleie eller annen næringsøyemed. Dette punkt er likevel ikke til hinder for at Båten benyttes til sleping av mindre vannleker som oppblåsbare pølser, ringer etc.
– Ved kjøring i indre havn er maks hastighet 5 knop
– Båten skal ligge fortøyd og ikke benyttes etter mørkets frembrudd (klokkeslett varierer med tid på året)

9. AVBESTILLING

Leietaker kan kansellere leieforholdet mot betaling av en erstatning til Båteier etter følgende modell:

  • Ved avbestilling mer enn fire uker før Leieperioden, betales 30 % av Leieprisen.
  • Ved avbestilling mellom fire og en uke før leieperioden, betales 50 % av Leieprisen.
  • Ved avbestilling mindre enn en uke før Leieperioden, betales 90 % av Leieprisen.

Dersom Båteier får leid ut båten i leieperioden, skal erstatningen avkortes slik at det som utleieren får inn skal trekkes fra den avtalte leie. Likevel skal leietakeren alltid betale 30 % av leiebeløpet.

10. PARTENES ANSVAR

Leietaker er kjent med at leiekontrakten er inngått av Båteier eller dennes representant. Lofoten Boat, Båteier, har ikke ansvar for Leietakers eller andre passasjerers medisinske tilstand, eller konsekvenser av denne. Leietaker innehar det fullstendige ansvar for seg selv og sine passasjerer.

11. ENDRINGER, KRAV TIL SKRIFTLIGHET

Tillegg til og endringer av leievilkårene i denne avtale er bindende bare dersom de foreligger i skriftlig overenskomst.

12. TVISTER

Eventuell tvist mellom partene skal forsøkes løst i minnelighet. Dersom forhandlinger ikke fører frem har partene vedtatt Salten og Lofoten tingrett som rett verneting i enhver sak.

Om turistfiske

Lofoten Boat er registret som turistfiskevirksomhet hos Fiskeridirektoratet.

Lofoten Boat skal i henhold til «Forskrift om rapportering av fangster fra turistfiskevirksomheter» rapportere til direktoratet om kundenenes fangster av torsk, kveite, sei, uer og steinbit. Hele forskriften kan du lese her.

Om rapportering av fangst

Fangstene skal rapporteres som antall fisk per art, per båt og per fisketur fordelt på fangstdato. Rapporteringen skal inkludere fisk som er fanget men som ikke tas med til land. Også fisketurer uten fangst av de nevnte arter skal rapporteres (nullfangst).

Fra og med 1. januar 2022 skal fangstrapportering skje ved bruk av digitale systemer som er godkjent av Fiskeridirektoratet. Lofoten Boat benytter løsningen GoFish til registrering, rapportering og dokumentasjon av fangst. Våre kunder vil få tilgang til GoFish og logger seg inn i systemet og registrerer fangst etter hver fisketur. 
Fangsten rapporteres automatisk til Fiskeridirektoratet og nødvendig dokumentasjon til eventuell utførsel av fisk (se under) genereres i løsningen.

Utførsel av fisk

Utførselskvoten er 18 kg for gjester ved registrerte turistfiskebedrifter. Turistfiskere skal dokumentere at fisket er gjort i regi av en registrert turistfiskebedrift når fisk tas ut av landet.

NB! Det er kun mulig å utføre fisk dersom du har fisket og oppholdt deg hos en registrert turistfiskebedrift. Utførselskvoten er 18 kilo fisk eller fiskeprodukt. Du kan ta med deg utførselskvoten inntil to ganger per år.

Tolletaten vil ved utførsel kreve dokumentasjon på fangster den enkelte turistfisker har rapportert til turistfiskevirksomheten. En slik utskrift eller pdf-fil må inneholde:

  • Navn på virksomheten
  • Navn på hvem som har fisket
  • Hvor mye som er fisket

Personene som er navngitt på dokumentet må være med når fisken blir ført ut av landet.

Whether you’re taking a quick afternoon cruise or a day trip to the Lofoten Sea, the 805 Pilothouse’s saloon table and adjustable seats are a great place to relax or seek shelter. Lofoten has a fantastic archipelago that invites you to great boating experiences and many opportunities, whether you use a motorboat or are a sailor. Combined with the fjords surrounded by high mountains, the coast along the Lofoten Wall is an attractive destination.

If you are setting out by boat in Lofoten for the first time, it is important to be aware that navigating these waters requires good planning, full focus and caution. For example, if you have rented a boat in Greece or Croatia, you will be able to experience that Norwegian waters have several underwater reefs, and not least that the temperature in the water is significantly lower.

To prepare you as best as possible for the boat trip in Norwegian waters, before you rent a boat, we ask that you go through all the information on this page, and not least take 3 minutes to watch the safety film below.

The rules of the sea

The safety film above summarizes the Maritime Law in a good way, and for us at Lofoten Boat it is a matter of course that everyone who travels on the sea should know and follow these. Unfortunately, in practice this is not always the case, and many of us need to be reminded of the rules before a new season. We therefore also ask you to read through these 7 rules:

  1. Think safety: Knowledge and planning reduce risk and increase well-being.
  2. Bring the necessary equipment: The equipment must be kept in order and be easily accessible.
  3. Respect the weather and waters: The boat must only be used in suitable conditions.
  4. Follow the rules of the sea: The provisions on the obligation to give way, speed and the use of lanterns must be observed.
  5. Use a life jacket or flotation device: approved flotation equipment is required for everyone on board.
  6. Be rested and sober: the blood alcohol limit is 0.8 when driving a boat.
  7. Show consideration: Safety, the environment and well-being are a shared responsibility.

Our Safety Goal

Lofoten Boat’s aim is that all boat hire should take place without damage to people or material. To achieve this goal, we have implemented a number of measures to prevent damage and ensure that you as a customer have a safe and good boating experience.

One example of such a measure is that you as a customer must sign a checklist that you have read and understood the text under “Before renting a boat” on our website before you are handed over the boat.

Read before renting and handing over the boat

Some important points to be aware of
before you hire a boat from Lofoten Boat:

  1. The Hirer and other drivers of the boat must be over 20 years of age.
  2. The Hirer and other drivers of the boat born after 31.12.1979 must provide  a valid boat driver´s licence.
  3. When driving a boat in the inner harbour, the maximum legal speed is 5 – five – knots.
  4. When driving closer than 50 m from shore, bathers and bathing buoys, the maximum speed is 5 knots. (See legal data for the applicable legislation)..
  5. The boat must not be used after dark.
  6. Lofoten Boat’s boats are equipped with tracking devices, wich among other things registers speed and route.
  7. No-go zones have been entered in chartplotters, with notification to Lofoten Boat if these are not complied with.

1. RENTAL PERIOD, DELIVERY AND RETURN


The duration of the agreement (the ”Rental Period”) shall be from the Rental Time to the Return Time as stated above. Lofoten Boat (hereinafter referred to as the ”Boat Owner”) shall, at the time of Rental, hand over the Boat to the Hirer at the Delivery Point as stated above and The Hirer shall, at the Time of Return, return the Boat to the Boat Owner at the same location, unless otherwise agreed in writing. Both parties have a mutual duty to notify and wait for 30 minutes in the event of a delay.


If, due to weather conditions, it is not or will not be advisable to hand over/return the Boat as agreed, the party who must hand over/return as soon as possible and no later than one hour before the agreed time, contact the other party to agree a new Rental or Return time. New Rental or Return time must be agreed as soon as the weather conditions make it reasonable.


If the The Hirer does not show up at the agreed Rental Time, the Rental Period begins to run, and Lofoten Boat may impose a fee as a result of non-collection in accordance with the current rates established by Lofoten Boat and published at www.bjorback.no or www.svolvaerhavn.no/ boat rental Lofoten.


If The Hirer does not show up for more than one day, when the rental period is over a week and this happens without the Boat Owner giving any notice to the landlord, the rental is terminated. In such cases, the Boat Owner must still pay full rent for the first full week. For later rental weeks, the rental price must be reduced corresponding to the replacement rental obtained.


If The Hirer does not show up at the agreed return time, a fee for non-return will be charged according to the current rates determined by Lofoten Boat and published on www.bjorback.no or www.svolvaerhavn.no/batutleie-lofoten. In the event of non-attendance at the agreed Return Time, the Rental Period continues to run on the other terms of the agreement until the boat is returned to the Boat Owner. In such cases, the Hirer is responsible for returning the Boat to the location specified by the Boat Owner.


The hirer is responsible for all expenses, costs and losses Boat owner is applied if the boat is not returned by the agreed return time.


2. RENTAL PRICE


The Hirer is obliged to pay Lofoten Boat the rental price stated above. Any additional options and additional equipment and services are added and follow the current price list.


If the Rental Date is postponed due to weather conditions as mentioned in point 1., the Rental Period shall be extended by agreement corresponding to the postponement.


If it is not possible to extend the Rental Period (for example because the boat has been rented out or because The Hirer does not have the opportunity to use it) the Rental Price must be shortened.


In the event of deferred handover due to conditions attributable to the Boat Owner or conditions for which the Boat Owner bears the risk, the Hirer may request that the Rental Period be extended corresponding to the postponement or that the Rental Price be shortened corresponding to the postponement.


If it is not possible to extend the Rental Period (for example because the boat has been rented out or because the Boat Owner does not have the opportunity to use it), the Rental Price must be reduced corresponding to the postponement.


3. SPECIAL AGREEMENT ON TRANSPORT


If the parties have agreed delivery and/or return at a place outside the Boat Owner’s address and the boat’s home port, Lofoten Boat can offer transport of the Boat by further agreement.


4. THE BOAT’S CONDITION AT HANDOVER AND THE BOAT OWNERS OBLIGATIONS


Upon handover, the boat must be in contractual condition, cleaned and have a full fuel tank. Upon handover, The Hirer and Boat Owner must together inspect the entire Boat using appropriate checklists that Lofoten Boat has. Checklists for reviewing the boat in question are ticked off as a separate point in the contract.


If the Boat is not ready for handover at the agreed time due to conditions on the Boat Owner’s side, the rental shall be reduced by one day’s rental for each day begun.


If the delay is more than one day in the case of up to one week’s rent, or more than two days in the case of more than one week’s rent, The Hirer can choose whether he wants to maintain or withdraw from the agreement.


If the Boat is not in contractual condition, The Hirer can demand a reduction in the rental price.


If the deficiency is of a serious nature, the Boat Owner may choose to withdraw from the agreement.


If the Boat cannot be used for part of the Rental Period, and this is due to circumstances for which the Boat Owner is responsible, the rental must be shortened proportionately.


5. CONDITION OF THE BOAT ON RETURN, DAMAGES AND THE HIRER´S OBLIGATIONS


On return, the boat must be in the same condition as on handover, cleaned and have a full fuel tank, unless otherwise agreed.


If the Boat is not satisfactorily cleaned or fully refueled upon return, the Renter will be charged a fee for washing and/or a fee for filling the engine seat, as well as a pump price (however minimum NOK 30 per litre) for lack of fuel according to current rates. The debt rates price for fuel are the relevant day’s rates at Circle K, Svolvær brygge’s petrol pump station.


The Hirer is responsible for theft and any damage or lack of the Boat, including the Boat’s engine and equipment, other damage or liability for damages incurred, incurred or arising as a result of the Hirer’s use of the Boat. The Renter is financially responsible for expenses incurred by the Boat Owner in connection with cleaning, repairs and transport due to internal and external damage and/or damage caused to the Boat during the rental period. The boat is insured, in the event of theft or damage/liability that is fully or partially covered by insurance, the Hirer is responsible for payment of the Boat Owner’s deductible as well as any other financial losses.


If problems of any kind arise with the Boat during the Rental Period, the Renter is obliged to immediately notify Lofoten Boat of the incident. In the event of non-insignificant damage, the hirer is obliged to follow Lofoten Boat’s instructions.


6. REQUIREMENTS FOR THE HIRER AND DRIVER(S) OF THE BOAT


The Hirer must possess the necessary and sufficient competence to hire and operate the Boat. The Hirer and other driver´s of the Boat must be at least 20 years of age. If the Hirer or other driver´s of the Boat is born after 01.01.1980, they must provide a valid Boat driver´s licence. Mapping such competence is an important part of the reservation process and must be carried out by the Boat Owner before the reservation is carried out. This is to ensure that the hirer has the necessary skills and the right attitudes for safe travel at sea. It is the The Hirer´s responsibility to make sure that they are familiar with the area they will be traveling in and that all passengers have life jackets in the correct size according to regulations. It is The Hirer’s responsibility to ensure that he or she has sufficient competence to operate all aspects of operating a boat.


The Hirer confirms that all drivers of the Boat during the Rental Period are over 20 years of age and possess sufficient knowledge and any certificates/evidence required to drive the Boat. The Hirer is responsible for ensuring that all drivers of the Boat are made aware of the terms of this agreement in advance.


If the Hirer has given incorrect information about his own or other drivers’ qualifications and skills, or that for other reasons it is considered clearly unjustifiable to hand over the vessel, the Boat Owner has the right to terminate the agreement with immediate effect.


When mooring the boat, the Hirer or driver of the Boat is obliged to ensure that the Boat is properly secured on a wharf/mooring place where this has been clarified with the owner of the facility/place. Likewise, the Hirer or driver of the Boat is obliged to ensure that the Boat is properly closed and locked.


7. THE HIRERS MAINTENANCE OBLIGATION


During the rental period, The Hirer must ensure that the Boat is maintained, including regarding lubricating oils, cooling water and liquids.

8. RESTRICTION ON USE OF THE BOAT AND SPECIAL PROVISIONS


The boat can only be used in Scandinavian waters. The boat must not be used to tow paragliders or similar equipment. The boat may also not be used for towing tasks, salvage of other boats (except in emergency situations), transport tasks where the hirer charges for the task, rental, or other commercial purposes. This point does not prevent the boat from being used for towing smaller water toys such as inflatable sausages, rings etc.


  • While driving in inner harbour and less than 50 m from land, the max speed is 5 – five- knots
  • The Boat shall not be in use when its dark (time of day will vary with time of year)

9. CANCELLATION


The Hirer can cancel the rental against payment of compensation to the Boat Owner according to the following model:


  • In case of cancellation more than four weeks before the Rental Period, 30% of the Rental Price is paid.
  • In case of cancellation between four and one week before the rental period, 50% of the rental price is paid.
  • In case of cancellation less than a week before the Rental Period, 90% of the Rental Price is paid.

If the Boat Owner rents out the boat during the rental period, the compensation must be reduced so that what the lessor receives must be deducted from the agreed rent. Nevertheless, the Boat Owner must always pay 30% ofthe rental amount.


10. LIABILITY OF THE PARTIES


The hirer is aware that the hire contract has been entered into by the Boat Owner or his representative. Lofoten Boat, the Boat Owner, is not responsible for The Hirer or other passengers’ medical condition, or the consequences thereof. The Hirer has full responsibility for himself and his passengers.


11. CHANGES, REQUIREMENTS FOR WRITING


Additions to and changes to the rental terms in this agreement are binding only if they are contained in a written agreement.


12. DISPUTES


Any dispute between the parties must be resolved amicably. If negotiations do not lead to progress, the parties have adopted the Salten and Lofoten District Court as the right venue in any case.

About Tourist Fishing

Lofoten Boat is registered as a tourist fishing business with the Directorate of Fisheries.

Lofoten Boat must, in accordance with the “Regulations on the reporting of catches from tourist fishing businesses”, report to the directorate about the customers’ catches of cod, halibut, pollock, redfish and catfish. You can read the entire regulation here (Norwegian).

About reporting of catches

Catches must be reported as the number of fish per species, per boat and per fishing trip divided by catch date. The reporting must include fish that are caught but not taken ashore. Fishing trips without catching the mentioned species must also be reported (zero catch).

From 1 January 2022, catch reporting must be done using digital systems that have been approved by the Directorate of Fisheries. Lofoten Boat uses the  GoFish solution for registration, reporting and documentation of catches. Our customers will gain access to GoFish and log into the system and register their catch after each fishing trip.
The catch is automatically reported to the Directorate of Fisheries and the necessary documentation for possible export of fish (see below) is generated in the solution.

Export of fish

The export quota is 18 kg for guests at registered tourist fishing establishments. Tourist fishermen must document that the fishing was done under the auspices of a registered tourist fishing company when fish is taken out of the country.

NB! It is only possible to export fish if you have fished and stayed with a registered tourist fishing company. The export quota is 18 kilograms of fish or fish products. You can take the export quota with you up to twice per year.

Upon export, the customs agency will require documentation of catches that individual tourist fishermen have reported to the tourist fishing business. Such a printout or pdf file must contain:

  • Name of the business
  • Name of who has fished
  • How much is fished

The persons named on the document must be present when the fish is taken out of the country.
